The Hague Convention on the Law Applicable to Trusts and on their Recognition has been ratified by Switzerland in 2006. It allows the recognition of foreign trusts in terms of civil law. Swiss companies can thus act as trustees of foreign trusts.
However, the tax treatment of trusts remains exclusively determined by the Swiss tax law. The latter was detailed by the Swiss Tax Conference in 2007 in a circular letter, which makes the trust a clear and simple structure for use by Swiss residents acting as settlors or beneficiaries.
